The main claim of this book is that a shift can be traced in the way that our increasingly complex, plural societies are conceptualized. Influential thinkers such as Weber, Berlin and Rawls can be characterized as disavowing an objective standpoint from which to balance and harmonize the tensions and conflicts of values in modern societies. Paradoxically, in an interdependent world, an objective standpoint is more crucial than ever. Our societies require legal justifications which are both pluralist and cohesive. The way forward is not only discourse ethics as developed by Habermas, but also the theories of balancing and principles, following Alexy, as a general theory of justification, and as terms of exchange to mitigate the consequences of disagreement.
